AdvysorTV permite a sus usuarios subir y publicar contenido (imágenes, videos y otros materiales) en sus pantallas a través de nuestra plataforma. Respetamos los derechos de propiedad intelectual y esperamos que nuestros usuarios hagan lo mismo.

Si crees que algún contenido publicado a través de AdvysorTV infringe tus derechos de autor, puedes enviarnos una notificación de retirada siguiendo el proceso descrito en esta página. Revisamos cada solicitud y actuamos en consecuencia en un plazo de 5 días hábiles.

Cómo enviar una notificación de retirada

Para que podamos procesar tu solicitud, tu notificación debe incluir toda la siguiente información:

  1. Identificación de la obra protegida. Describe la obra original cuyos derechos de autor crees que han sido infringidos (por ejemplo: "mi fotografía titulada X", "mi logotipo registrado Y").
  2. Identificación del contenido infractor. Describe con suficiente detalle el contenido que consideras infractor y, si es posible, proporciona la URL o el nombre de la cuenta del usuario que lo publicó en AdvysorTV.
  3. Tu información de contacto. Nombre completo, dirección de correo electrónico y, opcionalmente, número de teléfono o dirección postal.
  4. Declaración de buena fe. Una declaración de que crees de buena fe que el uso del material de la manera reclamada no está autorizado por el titular de los derechos de autor, su agente o la ley.
  5. Declaración de exactitud. Una declaración, bajo pena de perjurio, de que la información en tu notificación es exacta y que eres el titular de los derechos de autor o estás autorizado para actuar en nombre del titular.
  6. Firma. Tu firma física o electrónica.

Qué sucede después de tu notificación

  1. 01
    Revisión

    Revisamos la notificación para confirmar que contiene todos los elementos requeridos. Si falta información, te lo haremos saber.

  2. 02
    Retirada del contenido

    Si la notificación es válida, retiramos o desactivamos el acceso al contenido señalado en un plazo de 5 días hábiles y notificamos al usuario que lo publicó.

  3. 03
    Confirmación

    Te enviamos un correo confirmando que el contenido ha sido retirado.

Contranotificación

Si crees que tu contenido fue retirado por error o identificación incorrecta, puedes enviarnos una contranotificación a info@advysortv.com con la siguiente información:

  • Identificación del contenido retirado y la ubicación donde aparecía antes de ser eliminado.
  • Una declaración, bajo pena de perjurio, de que crees de buena fe que el contenido fue retirado por error o por identificación incorrecta.
  • Tu nombre, dirección y número de teléfono.
  • Tu firma física o electrónica.

Al recibir una contranotificación válida, la notificaremos al reclamante original. Si el reclamante no inicia una acción legal en un plazo de 10 días hábiles, podemos restablecer el contenido.

Política de infractores reincidentes

AdvysorTV puede suspender o cancelar permanentemente las cuentas de usuarios que incurran en infracciones reiteradas de derechos de autor.

Notificaciones falsas

El envío de una notificación de retirada falsa o de mala fe puede dar lugar a responsabilidad legal. Si tienes dudas sobre si el contenido infringe derechos de autor, te recomendamos consultar a un abogado antes de enviar una notificación.

How to submit a takedown notice

For us to process your request, your notice must include all of the following:

  2. Identification of the infringing content. Describe in sufficient detail the content you consider to be infringing and, if possible, provide the URL or the username of the account that published it on AdvysorTV.

  5. Accuracy statement. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
  6. Signature. Your physical or electronic signature.

What happens after your notice

  1. 01
    Review

    We review the notice to confirm it contains all required elements. If anything is missing, we will let you know.

  2. 02
    Content removal

    If the notice is valid, we remove or disable access to the identified content within 5 business days and notify the user who uploaded it.

  3. 03
    Confirmation

    We send you an email confirming the content has been removed.

Counter-notice

If you believe your content was removed by mistake or misidentification, you may send us a counter-notice to info@advysortv.com including:

  • Identification of the removed content and the location where it appeared before removal.
  • A statement, under penalty of perjury, that you have a good faith belief the content was removed by mistake or misidentification.
  • Your name, address, and phone number.
  • Your physical or electronic signature.

Upon receiving a valid counter-notice, we will forward it to the original complainant. If the complainant does not initiate legal action within 10 business days, we may restore the content.

Repeat infringer policy

AdvysorTV may suspend or permanently terminate the accounts of users who repeatedly infringe copyright.

False notices

Submitting a false or bad-faith takedown notice may result in legal liability. If you are unsure whether content infringes copyright, we recommend consulting a lawyer before submitting a notice.
